BYTON Privacy Policy

BYTON respects your privacy and recognizes the importance of your personal data. These are individual details about the personal and factual circumstances of a specific or identifiable natural person, such as name, postal address, e-mail address or telephone number, but also usage data such as the IP address (“Personal Data” or “Personal Information”). We are committed to protecting your information through our compliance with this Privacy Policy. We apply to the confidentiality and integrity of your Personal Data the same extremely high standard which we apply to our products.

This Privacy Policy describes the categories of Personal Data we are collecting when you visit the BYTON website www.byton.com (“Website”) and the Byton App (“App”) and use the services and functions provided on the App and the Website.

The App and the Website are operated by BYTON Limited, 13/F, Tower 1, Lippo Centre, 89 Queensway, Hong Kong, team@byton.com, as the controller of the Personal data (“BYTON”, “we” or “us”)

The hosting for the website is done by our IT supplier Amazon Web Services, Inc.,410 Terry Avenue North, Seattle WA 98109, USA.

The hosting for the App is done by Alibaba Cloud Computing (AliCloud) in the People’s Republic of China (https://www.alibabacloud.com/global-locations?spm=a3c0i.170826.1097638.dnavwhya3.27051548mTIxZ8) and in Germany by Amazon Web Services (AWS Services Region Frankfurt; for details see https://aws.amazon.com/de/region-frankfurt/) automatically depending on the region where the mobile phone is based (geo tracking). The user is also able to change the region manually under the Settings in the App. By changing the region, data will be stored and processed in this region under its laws and regulations.

Please note in this respect that for the People's Republic of China, there is currently no EU Commission decision within the meaning of Art. 45 (3) of the GDPR. This means that the EU Commission has not yet established that the data protection level of the People's Republic of China meets the requirements of the GDPR. You can revoke your consent at any time by notifying us without affecting the legality of the processing carried out on the basis of the consent until revocation.

As defined by the basic EU data protection regulations, we hereby act as responsible for the processing of your personal data. The headquarters of BYTON are in Hong Kong.

Please read this Privacy Policy carefully before using the App and Website because it explains how we will process personal data and how we use cookies. Using the App and Website indicates that you accept this Privacy Policy.


This Privacy Policy shall furthermore give information about the purposes for which your Personal Information is processed. In addition, we will inform you about the legal basis of processing as well as about our legitimate interest as far as processing is necessary for the purposes of our legitimate interest. For further information, you may as well contact us directly as described below about our practices for using, maintaining, protecting and disclosing that information.


BYTON is the parent company of the Byton Group and is responsible for the processing of your Personal Data on the Website and the App, during contacts with our customer service or direct marketing activities:

We especially collect your Personal Data if you contact us directly via our Website, App or via e-mail to request information about our products and services or if your contact details are transferred from other Byton Group legal entities or other third parties. Further, we collect your Personal Data if you reply to our direct marketing campaigns of if we acquired your Personal Data from external sources like social media sites.

BYTON further processes your data, provided the data is transmitted to BYTON by its authorised partners, if and to the extent the necessary data protection requirements are met.

Your Personal Data will be processed to administrate and fulfil your requests and - when applicable - for individualized marketing and market research by us as controller.

The Personal Information about you that we collect is the information you voluntarily give us when registering, requesting and using our services through our Website or the App. The following categories of Personal Data may be collected via the different services and contact channels described in this Privacy Policy:

  • Contact data: Information you provide to us such as name, phone number, address, e-mail address, country and cip code, birthday as well as image files uploaded by you on our Website or our App.
  • Other Personal Data: IP-address, VIN number, browser language version, browser version.

  • providing services and support for our products;
  • surveys for customer satisfaction which enable us to improve your experience should you need support from us, e.g. to identify you correctly if you make contact with us.;
  • providing updates to you about any changes to our policies, terms and conditions and any other matters which we may need to tell you;
  • advising you of our products and services, including our promotional campaigns, invitations to events, latest product announcements, offers or upcoming events, if you have provided your consent to do so;
  • providing you with essential service updates about our products;

  • identifying the functionality of the Website and App or our apps so we can fix things and make the Website and App or our apps better for you and other users;

According to Art. 13 (1) lit. c of the General Data Protection Regulation (“GDPR”) we have to inform you about the legal basis for the processing of your Personal Data by us.

Apart from collecting consent, the processing of your Personal Data for the above-mentioned purposes may be justified as follows:

According to Art. 6 (1) lit. b GDPR processing of Personal Information is lawful when necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract. Therefore, Art. 6 (1) lit. b GDPR serves as a legal justification for the processing of Personal Data in connection with the provision of services and products and conducting related measures.

In order to gain access to certain parts of our Website and App, registration may be required. Personal Information you are providing us within the scope of the registration process (e.g. name, email address, telephone number) will be processed by us for verification purposes on the legal basis of Art. 6 (1) lit. b GDPR.

According to Art. 6 (1) lit. f GDPR processing of Personal Data is lawful when necessary for the purposes of the legitimate interests pursued by us or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms which require protection of Personal Information. We rely on Art. 6 (1) lit. f GDPR to the extent that legal action or prevention measures as regards fraudulent activity are involved.

Additional use of your Personal Information will only take place as far as a statutory provision requires or allows this or provided that you have consented to it. Should your Personal Information be processed for a purpose other than that for which your Personal Information was collected, we will provide you with information on that other purpose and any other relevant information as referred to in this Privacy Policy.


When using the registration form, we collect your Personal Data (first name, last name, e-mail address, phone number, street (optional), city, zip/postal code, state/province, country/region and password) only to the extent provided by you. Please note for mandatory information the registration cannot take place without entering the requested information. The data processing serves the purpose of opening your app account. After registration, the user can voluntarily enter further non-mandatory data in his/her personal profile (i.e. nickname, gender, birthday, profession, current vehicle, areas of interest, mobility interest) or update his/her data after registration.

By inserting your data you agree to the processing of the transmitted data. The processing takes place on the basis of Art. 6 (1) lit. a GDPR with your consent.

By registering we also may process your Personal - if indicated - to give you personalised information Data (especially by email and phone) tailored to your interests about new products and services, events, marketing and company communications. We will use your Personal Data for our own advertising purposes only, independently of the execution of the contract. By registering you expressly agree to this further processing of the transmitted data. The processing takes place on the basis of Art. 6 (1) lit. a GDPR with your consent.

You can revoke your consent under “Settings/Notifications for Push Notifications, Email, Text Messages, Phone Calls separately at any time without affecting the legality of the processing carried out on the basis of the consent until revocation.


Reservation on the App is only possible when you have already registered. When using the reservation form, besides the data already collected during the registration process, we collect your Personal Data (first name, last name, country/region, province, street, city and postal code). As mandatory information the registration cannot take place without entering the requested information. The data processing serves the purpose of establishing contact and to register you in order to be first contacted to place a preorder once open in your location. Please note that you are obliged to download the App in order to follow the status of your reservation. By placing the reservation, you agree to the processing of the transmitted data. The processing takes place on the basis of Art. 6 (1) lit. a GDPR with your consent.

You can revoke the reservation at any time on the reservation status page in the vehicle section of the App.

By reserving we also may process your Personal Data to give you personalised information (especially by email and phone) tailored to your interests about new products and services, events, marketing and company communications. We will use your Personal Data for our own advertising purposes only, independently of the execution of the contract. By placing your reservation you expressly agree to this further processing of the transmitted data. The processing takes place on the basis of Art. 6 (1) lit. a GDPR with your consent.

You can revoke your consent for further processing at any time under “Settings/Notifications for Push Notifications, Email, Text Messages, Phone Calls separately at any time without affecting the legality of the processing carried out on the basis of the consent until revocation.


The reservation on the Website takes place in two steps (account creation and reservation).

Step 1 account creation

By using the registration form under step 1 for your account creation, we collect your Personal Data (first name, last name, e-mail address and password). As mandatory information the registration cannot take place without entering the requested information. The data processing serves the purpose of opening your website account. Step 2 reservation

Reservation on the Website is only possible when you have already registered under step one. When using the reservation form, besides the data already collected during the registration process, we collect your Personal Data (country/region, city, phone number and birthdate). As mandatory information the registration cannot take place without entering the requested information. The data processing serves the purpose of establishing contact and to register you in order to be first contacted to place a preorder once open in your location. Please note that you are obliged to download the App in order to follow the status of your reservation. By placing the reservation, you agree to the processing of the transmitted data. The processing takes place on the basis of Art. 6 (1) lit. a GDPR with your consent.

We are legally obliged to obtain prior consent from you in order to process your Personal Data for the aforementioned purposes. To that extent, we are using the double-opt-in method (confirmation of your email address by email prior to the beginning of the subscription) in order to verify consent. You may revoke your consent at any time with future effect which will not affect the processing of your Personal Information being undertaken until the revocation. If you want to stop receiving marketing or support communications from us, you can do so at any time with future effect by

  • contacting us on the contact details setting out in the Website team@byton.com stating that you no longer wish to receive such communications;
  • using the unsubscribe option, if applicable, included in the e-mail correspondence; logging into your account on the Website (or our Apps if applicable) and changing your preferences and information if applicable; or
  • such other way offered to you as set out in the Website or our App.

We will not sell or rent your Personal Information to anyone. We will not share your Personal Information with any third party outside of our organization, other than as reasonably necessary to fulfil the purpose for which you provided your information as described in this Privacy Policy or as otherwise necessary to provide the services of our Website and App and the services in connection with our Website and App for you. For instance, we may disclose your Personal Information to any of our affiliates who supports our business in order to fulfil the purpose, provided they are bound by contractual obligations to keep your Personal Information confidential and to use it only for the purposes for which we disclose it to them. The transfer or your Personal Information to third parties to the extent defined above is justified by Art. 6 (1) lit. b GDPR. Our legitimate interest insofar is to provide you with the services offered by our Website and App.

Occasionally we may be required by law enforcement or judicial authorities to provide Personal Information to the appropriate governmental authorities upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We may also share business or Personal Information when we believe, in good faith, that release is necessary to comply with the law; to enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of BYTON, its affiliates, employees, users or others. In any event, we will comply with the applicable data protection laws and if necessary and reasonably possible inform you accordingly.


You can visit our Website and App without providing any personal information. Each time you access our Website and App, usage data is transmitted through your internet browser and stored in log data (server log files). This stored data includes, for example, the name of the page accessed, the date and time of access, the amount of data transferred and the requesting provider. This data is used exclusively to guarantee the error-free operation of our Website and App and to improve our services. It is not possible to assign this data to a specific person.


We store Personal Data in accordance with the principles of data reduction and data economy only as long as it is necessary or prescribed by law (legal storage period). If the purpose of the information collected no longer applies or if the storage period ends, we block or delete the data.


When you access a Website and App, data is always logged for technical and organizational reasons. This includes: date and time, web browser, requesting IP address and domain, accessed page or file, status information about success or failure of the access. The log data of the web server are stored for 30 days and deleted after a statistical evaluation. A further use or passing on of this data does not take place. The evaluation serves to check the function of the web server or the Website and App.


BYTON is a company that operates globally. Personal Data ise processed by BYTON employees, and by service providers we have commissioned, preferably within the EU. If data is processed in countries outside of the EU, BYTON uses EU standard contracts, including suitable technical and organizational measures in order to ensure that your Personal Data is processed according to the European data protection standards.

We transfer your Personal Data to the following recipients for the purposes stated below: BYTON Limited, Hong Kong transfers your Personal Data to contracted service providers, such as IT providers, opinion research institutes, agencies) in order to support the administration of the aforementioned purposes and to other companies of the BYTON Group, including but not limited to BYTON GmbH, Germany; BYTON North America Corporation, USA; Beijing BYTON New Energy Technology Co., Ltd., China; Nanjing BYTON Electric Co. (Shanghai Branch), China.BYTON Limited, Hong Kong also transmits Personal Data to the commissioned IT service provider Amazon Web Services, Inc.,410 Terry Avenue North, Seattle WA 98109, USA. Its registered office is outside the European Economic Area (EEA) in a so-called third country without an adequate level of data protection. There is no adequacy decision from the European Commission, but an appropriate guarantee in the form of EU standard contractual clauses. We take precautions to protect your Personal Data from loss, destruction, falsification, manipulation and unauthorized access. The legal data protection regulations are of course always observed. We will neither pass on your Personal Data to third parties nor use them in any other way without your express consent. If you have given your consent, you can revoke it at any time with effect for the future. Our employees are bound to confidentiality. Should data be passed on to service providers within the framework of order data processing, they are also obliged to maintain confidentiality and are bound by data protection laws, other statutory provisions and this data protection declaration.


As you use our Website and App, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and usage patterns. It allows for tracking on-line behaviour in terms of time, geographic location and usage of this Website and App. This information is collected via tracking pixels and/or cookies. The legal basis insofar is Art. 6 (1) lit. b GDPR. We furthermore collect those data for the detection and defence of misuse which is justified by Art. 6 (1) lit. f GDPR and is being conducted in order to ensure the proper functioning of our Website and App. Furthermore, we collect and process information about the browser type you use as well as date and time of access and use of our Website and App based on Art. 6 (1) lit. f GDPR, in order to optimize our Website and App and our services.

The technologies we use for this automatic data collection includes cookies and other technologies (such as pixel tags) that are typically used on any other Website and App you are accustomed to visiting. We currently use Google Firebase Analytics of Google Inc to enable the functionality of our App. The information received from Google Firebase Analytics is used only to improve our App and the type of information displayed to App visitors, so we can better serve those interested in BYTON. Google Firebase Analytics is a free app measurement solution that provides insight on app usage and user engagement, provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Firebase uses tracking technologies that allow you to analyse your use of this APP, e.g. for performance monitoring, for error logs and for analysing user behaviour, such as which screens were viewed and which publications were opened how often. Firebase collects information about the use of the app and transfers it to Google in Ireland or the USA, where it is stored. The data is only collected anonymously and transmitted to Firebase. There is no link to other user data. Google will use this information to evaluate your use of our app and to provide us with other services associated with the use of apps. We currently use Pushy to send you push-up notification on the App. This app of Pushy LLC offers you the possibility to receive current information about our offer, news and relevant advertising by means of so-called push news. Push-messages are messages that appear without opening the respective app on your device. For the sending of push messages we use the technology of Pushy. The Pushy Service may use "cookies". Your web browser may set cookies for record-keeping purposes and sometimes to track information about you. You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. If you do so, note that some parts of the Service may not function properly. Pushy makes use of Google Analytics to track your interactions with the Pushy Server.

The Pushy Service makes use of log files, which track actions occurring on the Service. These log files may include data such as IP addresses, browser user agents, Internet service providers and any other data sent to The Pushy-Service, including data sent to Pushy’s API. We currently use Nexmo, the Vonage API Platform, to send you Text Messages on your mobile phone. Vonage Holdings Corp., including its corporate affiliates, is a global provider of cloud communications. For its business and residential customers, they offer a complete and fully-configured unified communications solution for the delivery of end-to-end communications via voice, video, text, mobile applications, and collaboration tools. Through the subsidiary Nexmo Inc., the Vonage API Platform, communications services in programmable modules delivered via APIs and SDKs are provided, enabling the customers to incorporate these services into their own applications to serve their own customers.

The Google Tag Manager is a tag management system created by Google to manage JavaScript and HTML tags used for tracking and analytics on websites (variants of e-marketing tags). The Google Tag Manager facilitates the implementation of Google Analytics and other web analytics tools on our Website and App. Also other tools can be integrated via the GTM. The tags set up via the Google Tag Manger ensure the collection of data that is passed on to the target system. Because the data is only passed on, the system does not collect or store the data itself.

The Google Tag Manger triggers other tags that may themselves collect data. Google Tag Manager does not access this data. If deactivation has been made at the domain or cookie level, it will persist for all tracking tags implemented with Google Tag Manager.

The Google Tag Manager is a cookie-free domain and therefore does not collect any Personal Data in this way. Tracking can nevertheless take place when using the service. The use of individual tags is recorded in the same way as the implementation method. Basically, the use of the Google Tag Manager is recorded and evaluated.
